Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of Pubdate, a WhatsApp-based social media management service for Irish pubs, operated as a sole trader in Ireland ("Pubdate", "we", "us").

By signing up for Pubdate, you agree to these Terms. If you do not agree, do not use the service. Questions? Email us at hello@pubdate.ie.

2. What Pubdate does

Pubdate is a managed social media service. Once connected, we:

  • Receive information about your pub (events, news, photos) via WhatsApp
  • Use AI to draft social media posts (Facebook, Instagram, Google Business Profile) on your behalf
  • Send you draft posts for review and approval via WhatsApp before publishing
  • Publish approved posts to your connected social accounts

Nothing is published without your explicit approval. You remain in control of your social media presence at all times.

3. Your account and responsibilities

To use Pubdate, you must:

  • Be the owner or an authorised representative of the pub you are registering
  • Provide accurate business information (pub name, address, contact details)
  • Maintain valid connections to your social media accounts by keeping OAuth permissions active. If a connection is revoked or expires, we will notify you via WhatsApp to reconnect.
  • Not use the service to publish content that is false, misleading, defamatory, illegal, or in breach of any social media platform's terms of service

You are responsible for all content published through your account. Pubdate acts as your agent in publishing, but you retain full responsibility for the content you approve.

4. AI-generated content

Posts are drafted using AI (Anthropic Claude). While we aim for high quality and accuracy, AI-generated content may occasionally contain errors, awkward phrasing, or inaccurate information.

You are responsible for reviewing and approving all posts before they are published. By approving a post, you confirm you are satisfied with its accuracy and appropriateness. Pubdate is not liable for errors in approved content.

5. Payment and billing

Pubdate is offered on a monthly subscription basis. Current pricing:

  • Bar (€49/month) — Google Business Profile updates and review management
  • Lounge (€99/month) — Facebook and Instagram social posting
  • Snug (€149/month) — all platforms combined, plus a custom link-in-bio page

A one-time setup fee may apply. All prices are exclusive of VAT where applicable. Subscriptions are billed monthly in advance via Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis.

We reserve the right to change pricing with 30 days' notice. Continued use of the service after the notice period constitutes acceptance of the new pricing.

6. Cancellation and refunds

  • You may cancel your subscription at any time via the dashboard or by emailing hello@pubdate.ie
  • Cancellation takes effect at the end of the current billing period. You will continue to have access to the service until then.
  • We do not offer refunds for partial months or unused portions of a billing period.
  • Upon cancellation, your social media connections will remain active until the end of the billing period, after which OAuth tokens are revoked and your data is deleted in line with our Privacy Policy.

7. Content ownership

You retain full ownership of all content you provide to Pubdate — including photos, event details, and business information.

By submitting content to Pubdate, you grant us a limited, non-exclusive licence to use, format, edit, and publish that content on your behalf to the social media platforms you have connected. This licence exists solely to deliver the service and terminates upon cancellation.

AI-generated post text produced by Pubdate on your behalf is considered your content once approved and published.

8. Limitation of liability

Pubdate is provided "as is". To the fullest extent permitted by Irish law, we are not liable for:

  • Outages, downtime, or policy changes at Facebook, Instagram, Google, WhatsApp, or any other third-party platform
  • Reduction in social media reach, engagement, or algorithmic changes by any platform
  • Failures or interruptions caused by third-party processors (Twilio, Stripe, Supabase, Anthropic, etc.)
  • Any indirect, incidental, or consequential loss arising from use of the service
  • Loss of data caused by events outside our reasonable control

Our total liability to you for any claim arising from these Terms shall not exceed the total fees paid by you to Pubdate in the 3 months preceding the claim.

9. Termination

Either party may terminate the subscription with 30 days' written notice (email or WhatsApp). We may terminate your account immediately and without notice if you:

  • Breach these Terms and fail to remedy the breach within 7 days of notice
  • Use the service to publish unlawful, defamatory, or harmful content
  • Fail to pay subscription fees
  • Provide false or misleading information that materially affects the service

Upon termination, all outstanding fees become immediately due. Sections 7 (Content Ownership), 8 (Limitation of Liability), and 10 (Governing Law) survive termination.

10. Governing law

These Terms are governed by the laws of Ireland. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.

11. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes via WhatsApp at least 30 days before the changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
